Terms & conditions

Last updated: 11 September 2026

1. Agreement

These terms form an agreement between you (the customer) and Atyvia. By creating an account or using the service, you agree to these terms. If you are agreeing on behalf of a business, you confirm you have authority to do so.

2. The service

Atyvia receives customer enquiries from the channels you connect, generates replies in your business voice, and sends follow-ups and reminders. Features available to you depend on the plan you select.

3. Plans, fees and billing

Paid plans are billed monthly or annually in advance in pounds sterling. Annual plans are billed for twelve months at the discounted rate shown at checkout. Fees are non-refundable except where required by law.

You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.

We may change our prices with at least 30 days' notice. Changes will not affect the period you have already paid for.

4. Your responsibilities

You are responsible for the accuracy of the information you provide to Atyvia, for the content of communications sent from your channels, and for keeping your account credentials secure.

You must not use Atyvia to send unlawful, misleading, abusive or unsolicited bulk messages, or in any way that breaches the rules of a connected messaging platform or applicable marketing and privacy laws.

5. Automated responses

Atyvia generates responses automatically. While we work hard to keep replies accurate and on-brand, you remain responsible for the communications sent from your business. We recommend reviewing your configured answers and escalation rules regularly.

6. Data and privacy

You retain ownership of your data and your customers' data. We process it only to provide the service, as described in our privacy policy. We act as a processor for conversation data you route through Atyvia.

7. Intellectual property

Atyvia and all associated software, branding and documentation remain our property. You receive a non-exclusive, non-transferable right to use the service during your subscription.

8. Availability

We aim for high availability but do not guarantee uninterrupted service. We may carry out maintenance and will give reasonable notice for planned downtime where possible. Service levels may be agreed separately on custom plans.

9. Liability

To the fullest extent permitted by law, our total liability arising from the service is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits or lost business. Nothing in these terms limits liability that cannot lawfully be limited.

10. Suspension and termination

We may suspend or end your access if you breach these terms, if required by law, or if your use puts the service or other customers at risk. You may close your account at any time from your account settings or by contacting us.

11. Changes and governing law

We may update these terms; we will notify you of material changes before they take effect. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
